01Acceptance
These Terms of Use ("Terms") are an agreement between you and Serpinty ("we", "us"), the developer of the Warbi app (the "App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.
02Eligibility
You must be at least 13 years old, or the minimum age required in your country, to use the App. If you are under the age of majority, a parent or guardian must agree to these Terms for you.
03License
We give you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. The App is licensed, not sold.
You may not copy, modify, reverse engineer, decompile or redistribute the App, remove its notices, or get around its subscription checks, except where the law allows it.
04What Warbi does
Warbi opens chats that you export from your messaging app (Export Chat, as a .zip or .txt file) and share to Warbi or pick with "Choose file". It can also read chat screenshots you pick, using on-device text recognition. Warbi keeps these chats as archives on your iPhone, where you can read and search them, view their photos, videos, voice notes, files and links, and jump to a date.
Warbi also offers chat recaps, stats, the links, phone numbers, addresses and dates mentioned in a chat, PDF export, voice note transcripts, and a set of free tools (such as Quick Send, chat links and QR codes, reminders, text and voice note tools, and photo tools).
Recovery Mode (Premium) is a recycle bin for Warbi's own archives. An archive deleted inside Warbi waits 7 days in Recently Deleted and can be put back. It does not and cannot bring back messages deleted in any other app.
Warbi does not look through your device, does not access your messaging app, its account, servers or backups, does not read anything you didn't pick, and does not bring back deleted messages. Warbi is not a backup service.
Transcripts and text recognition depend on Apple's speech and Vision technology and may not always be accurate.
05Your content
The chats, media and files you add to Warbi remain yours. They are stored only on your iPhone, and we never receive them. You are responsible for keeping your own copies of your export files. If you delete the App, use "Delete all data", or lose your device, your archives in Warbi are gone.
06Acceptable use
You agree to:
- only add chats and screenshots that you have the right to keep, and respect the privacy of the other people in them;
- use the tools (such as Quick Send, chat links, reminders and photo tools) lawfully, and not for spam, harassment or to infringe anyone's rights;
- not share content from your archives in a way that breaks the law or harms others;
- not misuse the App, interfere with it, or abuse free trials.
08Free trial
Eligible new subscribers get a 3-day free trial. Eligibility is decided by Apple. Unless you cancel at least 24 hours before the trial ends, it becomes a paid monthly subscription and your Apple Account is charged.
09Cancellation
Deleting the App does not cancel your subscription. To cancel, open Settings › [your name] › Subscriptions › Warbi, then tap Cancel Subscription. Premium stays active until the end of the period you've paid for.
10Refunds
Refunds are handled by Apple. You can request one at reportaproblem.apple.com. We can't issue refunds ourselves. This doesn't limit any rights you have under consumer law.
11Intellectual property
The App, its design, code, text and graphics, and the Warbi name and logo belong to Serpinty or its licensors. You may not use them without our written permission. Other product names belong to their owners.
12Other apps & services
Warbi works with files you export from your messaging app and opens chat links in your messaging app. Warbi is an independent app and is not affiliated with or endorsed by any messaging service. Those services are governed by their own terms, and we are not responsible for them. Apple services used by the App (such as StoreKit, speech recognition and Vision) are governed by Apple's terms.
13Privacy
Our Privacy Policy explains how information is handled. In short, your archives stay on your iPhone and the App doesn't track you.
14Updates
We may update the App to fix problems or add, change or remove features. We may limit or stop offering the App in some places, or stop it altogether, with reasonable notice where possible.
15Termination
You can stop using the App at any time by deleting it and cancelling your subscription. We may end your license if you seriously break these Terms. Sections that by their nature should continue (such as intellectual property, disclaimer, limitation of liability and governing law) survive termination.
16Disclaimer
To the extent allowed by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.
We don't promise that the App will be error-free or uninterrupted, that every export file or screenshot can be read, or that transcripts, text recognition, recaps or stats will be complete or accurate. Some places don't allow these exclusions, so some may not apply to you.
17Limitation of liability
To the extent allowed by law, Serpinty is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of or inability to use the App. Our total liability is limited to the amount you paid for Warbi Premium in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, or your mandatory rights as a consumer.
18Indemnity
To the extent allowed by law, you agree to cover Serpinty against claims and costs arising from your breach of these Terms, your misuse of the App, or content you add to or share from the App.
19Apple terms
If you got the App from the App Store:
- These Terms are between you and Serpinty, not Apple. Serpinty, not Apple, is responsible for the App and its content.
- Your license is limited to using the App on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, including Family Sharing where enabled.
- Serpinty is solely responsible for maintenance and support. Apple has no obligation to provide any.
- If the App fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the extent allowed by law, Apple has no other warranty obligation.
- Serpinty, not Apple, is responsible for handling claims about the App, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection or privacy law.
- Serpinty, not Apple, is responsible for investigating, defending and settling any claim that the App infringes someone's intellectual property rights.
- You confirm that you are not in a country under a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must follow any applicable third-party terms when using the App.
- Questions or claims about the App go to Serpinty at support@serpinty.com.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
20Governing law
These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved by the courts and enforcement offices of Ağrı, Türkiye. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring claims in its courts. Consumers in Türkiye may also apply to Consumer Arbitration Committees or Consumer Courts under Law No. 6502.
21General
These Terms and the Privacy Policy are the whole agreement between you and us about the App. If a part is found unenforceable, the rest still applies. Not enforcing a right is not a waiver. You may not transfer these Terms; we may transfer them as part of a business transfer. If a translation differs, the English version applies unless local law says otherwise.
22Changes
We may change these Terms. We will update the "Last updated" date above and give notice in the App for important changes. If you keep using the App after a change, you accept the new Terms.
